Attorney General Says Fatal SFPD Shooting Justified

A Sioux Falls standoff that ended in a fatal shooting was justified says the entities involved with the investigation. 

Attorney General Marty Jackley and the Division of Criminal Investigation were requested on behalf of the Sioux Falls Police Department to look into the shooting of 22 year-old Jacob Daniel Westberg on October 14, 2013.  In a quick recap, Sioux Falls police were summoned to the 6600 block of West 15th Place on an initial suicide call, which escalated to a standoff with law enforcement.

After the incident, Police Chief Doug Barthel was quoted, “After making contact a few times, the subject then came out of the residence, pointed a long rifle at the officers that were on the scene.  As soon as that happened one of our SWAT officers shot him at least a couple of times.”

In a news release issued Thursday, Jackley statement was as follows.  “It is the conclusion of this investigation and the Attorney General that the officer was justified in firing his weapon and using lethal force.  I would like to thank the Sioux Falls Police Department, the officers involved and the witnesses for their complete cooperation in this investigation.”
