Will the Sioux Falls School Board Fire Someone Wednesday?

Someone associated with the Sioux Falls School District is getting an evaluation.  No pitchforks or torches, please as the Sioux Falls School Board needs to do the job we asked it to do. 

The Sioux Falls School District sends out an agenda as required by law whenever the School Board intends to meet.  On Wednesday at 3pm, this is what the Board intends to accomplish:

1. Call to Order

2. Executive Session – SDCL 1-25-2 (1)

3. Adjournment

There’s not even an approval of the minutes from the previous meeting.  So this gathering looks to be plenty serious.

One other fragment of grave nature is the codified law listed as the reason for Executive Session.  The statute reads:

  1-25-2.   Executive or closed meetings–Purposes–Authorization–Misdemeanor. Executive or closed meetings may be held for the sole purposes of:

(1)    Discussing the qualifications, competence, performance, character or fitness of any public officer or employee or prospective public officer or employee. The term “employee” does not include any independent contractor.

There are four other categories that are allowed for public entities to speak privately, but subsection 1 is listed as the impetus for this upcoming congregation of the Sioux Falls School Board.

Much like any private business, the need for evaluation of employees is incumbent on those in charge to decide whether to take action.  Look for the board to take the appropriate course of action after the closed session discussion.  After the reasons listed in the law for closed talks, it is abundantly clear that any action must be made in public.  The rest of 1-25-2 reads:

However, any official action concerning such matters shall be made at an open official meeting. An executive or closed meeting shall be held only upon a majority vote of the members of such body present and voting, and discussion during the closed meeting is restricted to the purpose specified in the closure motion. Nothing in this section may be construed to prevent an executive or closed meeting if the federal or state Constitution or the federal or state statutes require or permit it. A violation of this section is a Class 2 misdemeanor.

If anything is amiss within the confines of Sioux Falls Schools, the School Board can be trusted to take the proper action.  Otherwise, there’s always the next election.
